EB-3 green card jobs in the U.S.

The EB-3 is the third preference employment-based immigrant visa category for foreign nationals to obtain permanent residency in the U.S. The EB-3 Green Card is a great option for both F-1 Student Visa Holders (and their F-2 visa family members) living in the U.S. as well as for those residing abroad. As long as you meet the legal requirements for an immigrant visa and have no ineligibilities under the law, you can qualify.

You must not have violated the status of your non-immigrant visa, and you must not have worked without employment authorization for over 6 months.

Steps in the EB-3 Visa Process

Learn how the EB-3 visa helps you become a Permanent Resident of the United States through the following key steps:

Step 1: Job Offer

Begin by applying for a qualified job with a U.S. employer. After successfully interviewing, you receive and accept an official EB-3 Job Offer Letter from your employer.

Step 2: PERM Filing (Labor Certification)

Your employer files a PERM labor certification with the U.S. Department of Labor. This step ensures there are no qualified U.S. workers available for the position and that hiring a foreign worker will not negatively affect U.S. wages and working conditions.

Step 3: I-140 Petition Filing

The employer files Form I-140 (Immigrant Petition for Alien Worker) with USCIS. This petition confirms the worker’s qualifications and the employer’s ability to pay the offered wage.

Step 4: Adjustment of Status or Consular Processing

If you are already in the U.S., you file Form I-485 to adjust your status to permanent resident. If you are outside the U.S., you go through consular processing at a U.S. embassy or consulate in your home country.

Step 5: Arrival in the U.S. as a Permanent Resident

Once approved, you enter the U.S. as a lawful permanent resident (Green Card holder) and are required to begin work with your sponsoring employer for at least one year.
