Begin by applying for a qualified job with a U.S. employer. After successfully interviewing, you receive and accept an official EB-3 Job Offer Letter from your employer.
Your employer files a PERM labor certification with the U.S. Department of Labor. This step ensures there are no qualified U.S. workers available for the position and that hiring a foreign worker will not negatively affect U.S. wages and working conditions.
The employer files Form I-140 (Immigrant Petition for Alien Worker) with USCIS. This petition confirms the worker’s qualifications and the employer’s ability to pay the offered wage.
If you are already in the U.S., you file Form I-485 to adjust your status to permanent resident. If you are outside the U.S., you go through consular processing at a U.S. embassy or consulate in your home country.
